These terms of use govern users (including but not limited to individuals, teams, etc.) (you, user) access to and use of Aura Smart Solution. (“we,” “us,” “our,” or “Aura”) products and services via our websites and mobile applications. This constitutes a legal agreement between users and Aura, so please agree to these terms before accessing Aura services.

1. General

1.1. Aura is the owner of all rights, titles, and interests in and to the Site, Service, Licensed Application, and Device. We reserve all rights not expressly granted in these Terms.1.2. Users need to read the terms carefully and agree to them before registration. By signing up or otherwise using any of Aura's services, you enter into a binding contract with Aura. By accessing any special service or product, you agree to these terms of use.1.3. Please note that we may, from time to time, update the Services, and these updates may occur automatically without additional notice. You hereby consent to these updates. If you do not, please stop using the Services. Your continued use of the Service is your agreement to all such additional terms.

2. Use of the Service

2.1. The Aura App needs to be in alliance with Aura-related products.

2.2. Aura only provides related web services, and users shall bear the relevant service fees (Phone bills for network connection) of any other related devices (Personal computer, phone, or other devices for network connection).

3. Account

3.1. By clicking “I Agree” on the Site, setting up a user account, or by accessing and using the Services (including the Site and Application), you accept and agree to these Terms on behalf of yourself or the entity you represent in connection with the access.

3.2. Users agree that Aura will not be liable for any loss or damage to the use of the account and will indemnify us for all damage or liability caused by such use.

4. Usage Standards

4.1. Users agree to comply with related rules, including but not limited to Regulations of the People's Republic of Malaysia for Safety Protection of Computer Information Systems, Regulations on the Protection of Computer Software, Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Cases Involving Copyright Disputes over Computer Network, Management Provisions on Electronic Bulletin Services in the Internet, Provisions for the Administration of Internet News Information Services, Measures for the Administrative Protection of Internet Copyright, and Regulation on the Protection of the Right to Communicate Works to the Public over Information Networks.

4.2. The Site is provided by Aura for your personal use only. You agree to use the Site and the Services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site or Services. Aura assumes no liability or responsibility for any loss or damage. You agree not to do any of the following:

Post, upload, publish, submit or transmit any Content via our Service that:

(1) infringes, misappropriates or violates a third party's intellectual property rights, or rights of publicity or privacy;

(2) violates or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability;

(3) is fraudulent, false, misleading or deceptive;

(4) is defamatory, obscene, pornographic, vulgar or offensive;

(5) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group;

(6) is violent or threatening or promotes violence or actions that are threatening to any person or entity;

(7) promotes illegal or harmful activities or substances.

4.3. You agree that all submitted or uploaded content (Your Content) on Aura is based on intellectual property.You are responsible for all of Your Content and for ensuring that your content and its use with any offering comply with all applicable laws and regulations and these Terms, and warrant that Your Content will not infringe or misappropriate any intellectual property or proprietary rights of any person or violate any applicable laws or regulations. You agree to indemnify and hold Aura harmless from and against all damages, losses, and expenses of any kind (including reasonable attorney fees and costs) arising out of or related to User Content you post or otherwise contribute; or your violation of any law or the rights of a third party.

 

4.4. If any third-party claims that Your Content infringes that third party's intellectual property rights, we reserve the right to remove user alleged infringement Content at its sole discretion. Unless you user can submit the documentary evidence to rule out the possibility of infringement, Aura will not recover the deleted content.

4.5. You agree not to directly or indirectly do any of the following:

(1) Use network service system for any unlawful purpose;

(2) Attempt to interfere with any function or service of Aura Application and Site;

(3) Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Aura or any of Aura's providers or any other third party (including another user) to protect the Service, License Application, or any Device

(4) Use, display, mirror or frame the Services, or any individual elements within the Services, Aura's name, or any Aura trademark, logo, or other proprietary information, or the layout and design of any page or form contained on a page, without Aura's express written consent.

(5) Request, collect any accounts, password, or other authentication from other Aura users to access Aura;

(6) Log in Aura account to get the proxy authenticate for any user;

(7) Provide tracking facility, including but not limited to identifying other users to view or operate on their profile;

(8) Impersonate others to access Aura without authorization.

4.6. If users violate any of the above agreements, Aura reserves the right to warn or terminate the account of user(s); you agree to indemnify Aura and our partners for all damage or liability caused by violations.

5. Privacy Policy

5.1. Before using Aura's products or services, you may need to provide personal data. We may use your personal data for the following purposes:

(1) To get authorizations from users

(2) To comply with the related laws and regulations

(3) To comply with and enforce applicable legal requirements

(4) To maintain public interests.

5.2. Aura may provide network services in cooperation with third parties. In this case, if the third party agrees to assume equal responsibility as protecting the privacy of the user, Aura has the right to offer the user's information to the third party.

5.3. Without revealing the privacy of individual users, we, Aura, have the right to improve our products and services through analyzing the efficiency of our business operations and evaluating market share.
